The national Health Insurance Portability and Accountability Act of 1996 provides protection of personal health information. PeaceHealth Southwest adheres to these guidelines, as well as applicable laws of the State of Washington and the United States. Rules and regulations of governing or accrediting bodies including, but not limited to, the Joint Commission on Accreditation of Healthcare Organizations and the Washington State Department of Health.
Where state law is more strict than HIPAA, Southwest must adhere to state law.
In brief, under HIPAA regulations, PeaceHealth Southwest is authorized to release a one-word condition and the location of the patient if::
- the patient (or patient's guardian or legal representative) has consented to be in the patient directory, and
- the patient is not in a category restricted by law (see Highlights of the PeaceHealth Southwest News Media Policy), and
- the person requesting the information provides the patient's name.
